1. APPLICATION AND INTERPRETATION
1.1 This 1:1 Coaching Policy ("Policy") forms part of, and is incorporated into, the Terms of Service ("Terms") of George James Chengadakary, a sole trader (ABN pending), trading as PTE with George ("Provider").
1.2 It applies to all Coaching Sessions, whether included in a Premium Plan or purchased as an Add-on.
1.3 Capitalised terms not defined in this Policy have the meanings given in the Terms. This Policy is subject to clause 14 of the Terms (Australian Consumer Law).
2. NATURE OF COACHING SESSIONS
2.1 Each Coaching Session is an individual online session of up to forty-five (45) minutes, conducted by video conference (Zoom, Google Meet or another platform nominated by the Provider). It is delivered by George or, where George is unavailable, by a suitably qualified coach appointed by the Provider.
2.2 The Provider will prepare for each Coaching Session by reference to the Student's diagnostic results, submitted responses and target score, and will direct the session to the Student's goals.
2.3 Coaching Sessions are limited to preparation for the PTE Academic test. Coaching Sessions do not include immigration assistance, legal advice or any guarantee of results. Clauses 7 and 8 of the Terms apply.
3. ENTITLEMENT AND VALIDITY
3.1 A Premium Plan includes two (2) Coaching Sessions, which must be used within the Access Period of that Plan.
3.2 A Coaching Session purchased as an Add-on is valid for three (3) months from its Purchase Date.
3.3 Coaching Sessions not used within their validity period expire automatically. Unused or expired Coaching Sessions: - (a) have no cash value; - (b) are not refundable; and - (c) may not be transferred, carried over or exchanged.
3.4 Coaching Sessions are personal to the Student and may not be transferred to, or attended by, any other person.
4. BOOKING
4.1 Coaching Sessions must be booked exclusively through the booking facility nominated by the Provider, within the times made available.
4.2 Bookings must be made not less than forty-eight (48) hours before the proposed start time.
4.3 A Student may hold no more than one (1) upcoming booking at any time.
4.4 The Student is responsible for confirming that the session time is displayed in the Student's correct local time zone.
4.5 The Student should submit any questions, and any responses for review, not less than twenty-four (24) hours before the session, using the form provided in the booking confirmation.
5. RESCHEDULING AND CANCELLATION BY THE STUDENT
5.1 A Student may reschedule a Coaching Session without charge by giving not less than twenty-four (24) hours' notice before the scheduled start time, through the link in the booking confirmation. Each Coaching Session may be rescheduled no more than two (2) times.
5.2 If the Student cancels or seeks to reschedule a Coaching Session less than twenty-four (24) hours before the scheduled start time, the Coaching Session is forfeited and deemed to have been used.
5.3 If the Student fails to attend a Coaching Session without cancelling or rescheduling in accordance with clause 5.1 (a "no-show"), the Coaching Session is forfeited and deemed to have been used.
6. LATE ATTENDANCE
6.1 The Student must join the session punctually, with a functioning camera, microphone and internet connection.
6.2 If the Student joins late, the session nonetheless concludes at the originally scheduled finishing time and will not be extended.
6.3 If the Student has not joined within ten (10) minutes of the scheduled start time, and has not notified the Provider, the Student is treated as a no-show, and clause 5.3 applies.
7. EMERGENCIES
7.1 If a Student fails to attend because of a genuine emergency beyond the Student's control (including hospitalisation, bereavement of an immediate family member or natural disaster), the Student may notify the Provider in writing within forty-eight (48) hours of the scheduled start time.
7.2 The Provider may, in its absolute discretion and upon receipt of reasonable supporting evidence, provide one (1) replacement Coaching Session. A replacement under this clause is a goodwill concession, is limited to one (1) per Plan, and does not constitute a waiver of clause 5.
8. TECHNICAL DIFFICULTIES
8.1 If a Coaching Session cannot proceed, or is curtailed by more than ten (10) minutes, because of a technical failure on the Provider's side, the Provider will reschedule the session, or provide the lost time in a further session, at no cost.
8.2 If a technical failure occurs on the Student's side, the Provider will use reasonable endeavours to continue the session by telephone or another available means for the remainder of the scheduled time. Time lost because of the Student's equipment or connection will not be replaced.
9. RESCHEDULING OR CANCELLATION BY THE PROVIDER
9.1 The Provider may reschedule a Coaching Session by giving the Student as much notice as reasonably practicable and offering an alternative time.
9.2 If the Provider cancels with less than twenty-four (24) hours' notice, or fails to attend, the Student will receive a replacement Coaching Session together with an additional fifteen (15) minutes, at no cost.
10. RECORDING
10.1 Coaching Sessions are not recorded unless both the Student and the coach expressly consent at the commencement of the session.
10.2 The Student must not record, or permit the recording of, any part of a Coaching Session without the coach's express consent.
10.3 Any recording made with consent is Course Material, and may be used solely for the Student's private study in accordance with clause 11 of the Terms.
11. CONDUCT
11.1 The Student must conduct themselves courteously and respectfully during Coaching Sessions.
11.2 The coach may terminate a Coaching Session immediately if the Student engages in abusive, threatening, discriminatory or otherwise inappropriate conduct, or appears to be impaired by alcohol or drugs. In that event, the Coaching Session is deemed to have been used, and the Provider may exercise its rights under clause 13 of the Terms.
