13.4 Clauses 7, 8, 11, 14, 15 and 18 survive termination or expiry of these Terms.

14. AUSTRALIAN CONSUMER LAW

14.1 Certain legislation, including the ACL, may confer rights and remedies that cannot be excluded, restricted or modified by agreement ("Non-excludable Rights").

14.2 The Services come with guarantees that cannot be excluded under the ACL. - (a) For a major failure with the Services, the Student is entitled to cancel the service contract and obtain a refund for the unused portion, or to compensation for the reduced value of the Services. - (b) The Student is also entitled to be compensated for any other reasonably foreseeable loss or damage. - (c) If a failure does not amount to a major failure, the Student is entitled to have the problem rectified within a reasonable time. If this is not done, the Student is entitled to cancel the contract and obtain a refund for the unused portion.

14.3 Nothing in these Terms or the Policies excludes, restricts or modifies any Non-excludable Right. Every provision of these Terms and the Policies is to be read subject to the Non-excludable Rights.

17.1 The Provider may vary these Terms from time to time by publishing the varied Terms on its website. The version of these Terms in force at the Purchase Date applies to that purchase.

17.2 In respect of the Practice Club, the Provider will give not less than thirty (30) days' notice of any variation that is materially adverse to the Student. The Student may cancel the subscription before the variation takes effect.

18. DISPUTE RESOLUTION

18.1 A Student who has a complaint or dispute must first notify the Provider in writing at [email protected], setting out the details of the complaint. The Provider will use reasonable endeavours to acknowledge the complaint within two (2) business days and to resolve it within fourteen (14) days.

18.2 If the dispute is not resolved within thirty (30) days of notification, either party may refer the dispute to mediation before commencing court proceedings.

18.3 Nothing in this clause 18 prevents a party from seeking urgent interlocutory relief, or limits the Student's right to contact a consumer protection agency, including the Office of Fair Trading Queensland.
