1. APPLICATION AND INTERPRETATION
1.1 This Refund and Cancellation Policy ("Policy") forms part of, and is incorporated into, the Terms of Service ("Terms") of George James Chengadakary, a sole trader (ABN pending), trading as PTE with George ("Provider").
1.2 Capitalised terms not defined in this Policy have the meanings given in the Terms.
1.3 This Policy is subject in all respects to clause 14 of the Terms (Australian Consumer Law). Nothing in this Policy excludes, restricts or modifies any Non-excludable Right.
2. NO REFUNDS FOR CHANGE OF MIND
2.1 Upon payment, the Student receives immediate access to the Course and the Course Materials. Accordingly, all purchases are final and the Provider does not provide refunds, credits or exchanges for change of mind. This applies to: - (a) all Plans, including Plans purchased at Founding prices; - (b) all Add-ons; - (c) Practice Club subscription payments; and - (d) Coaching Sessions.
2.2 The Student acknowledges that, before purchasing, the Student had the opportunity to review the free sample lessons and the description of each Plan published by the Provider.
3. CIRCUMSTANCES IN WHICH NO REFUND IS PAYABLE
3.1 Without limiting clause 2, and subject to clause 4, no refund, credit, extension or compensation is payable where: - (a) the Student does not achieve a desired PTE score, band or result, or is required to re-sit any test; - (b) any visa, migration, admission, registration or employment application of the Student is refused, delayed or otherwise unsuccessful; - (c) the Student does not access, use or complete the Course, the Portal, any Coaching Session or any Add-on within the applicable Access Period or validity period; - (d) the Student changes the Student's test date, study plans, migration plans or personal circumstances; - (e) the Student purchased an unsuitable Plan (the Student may instead upgrade under clause 7); - (f) the Student obtains the same or similar content elsewhere, whether free of charge or otherwise; - (g) Pearson changes the PTE Academic test after the Purchase Date; - (h) the Student's own devices, software, internet connection or email settings prevent or impair access to the Services; - (i) the Student's account is suspended or terminated under clause 13 of the Terms; or - (j) the Provider subsequently offers the same or a similar Plan at a lower price.
4. REMEDIES FOR FAILURE
4.1 Rectification. Where any part of the Services is not supplied as described, or is not supplied with due care and skill, the Student may notify the Provider under clause 5. The Provider will rectify the failure within a reasonable time. Where appropriate, the Provider will extend the relevant Access Period or Portal Days by any period of unavailability.
4.2 Major failure. Where a failure amounts to a major failure within the meaning of the ACL, the Student is entitled to the remedies set out in clause 14.2 of the Terms.
4.3 Billing errors. Where the Student has been charged more than once for the same purchase, charged an incorrect amount, or charged for a Practice Club period after validly cancelling under clause 8, the Provider will refund the amount charged in error in full.
4.4 Cessation of Services. Clause 13.3 of the Terms applies.
5. PROCEDURE
5.1 A request for a remedy must be made in writing to [email protected]. It must include: - (a) the Student's full name; - (b) the email address used for the purchase; - (c) the order details; and - (d) a description of the issue, with supporting evidence (such as screenshots) where available.
5.2 The Provider will use reasonable endeavours to acknowledge a request within two (2) business days and to resolve it within fourteen (14) days.
5.3 Any approved refund will be paid to the original payment method, in the currency of the original transaction. The Provider is not responsible for exchange-rate differences or charges imposed by the Student's financial institution.
6. PAYMENT DISPUTES AND CHARGEBACKS
6.1 The Student agrees to contact the Provider under clause 5 and allow the Provider a reasonable opportunity to resolve any issue before initiating a chargeback or payment dispute with the Student's bank, card issuer or payment provider.
6.2 If the Student initiates a chargeback or payment dispute without first complying with clause 6.1, or on grounds that this Policy does not support: - (a) the Provider may suspend the Student's access to the Services while the dispute is pending; - (b) the Provider may provide the payment provider with evidence in support of the transaction, including the order record, the Student's acceptance of the Terms at checkout, and records of the Student's access to and use of the Services; and - (c) where the dispute is resolved in the Provider's favour, the Provider may require payment of any fees it has incurred before restoring access. Where the dispute was raised after substantial use of the Services, the Provider may terminate the Student's account under clause 13 of the Terms.
6.3 Nothing in this clause 6 affects any Non-excludable Right, or any right of the Student to dispute a transaction arising from fraud or a genuine billing error.
7. UPGRADES
7.1 The Student may upgrade to a higher Plan during the Access Period by paying the difference between the then-current prices of the two Plans on the same country price list.
7.2 The Access Period of the upgraded Plan is calculated from the original Purchase Date.
7.3 Upgrade payments are not refundable. Downgrades are not available.
8. PRACTICE CLUB SUBSCRIPTION
8.1 The Practice Club is a recurring subscription. It renews automatically each month on the anniversary of the original Purchase Date, at the price applicable when the Student subscribed, until cancelled.
8.2 The Student may cancel at any time: - (a) through the billing or subscription settings of the Student's account; or - (b) by email to [email protected], received not less than twenty-four (24) hours before the next renewal date.
8.3 On cancellation, the Student retains access until the end of the current paid period, after which access ceases. No refund is payable for any part-period or unused Portal Days.
8.4 The Provider will give the Student not less than thirty (30) days' notice of any change to the subscription price. The Student may cancel before the change takes effect.
8.5 If a renewal payment fails, the Provider may re-attempt the payment and suspend access until payment is received.
9. COACHING SESSIONS
9.1 Rescheduling, cancellation, late attendance and non-attendance in respect of Coaching Sessions are governed by the 1:1 Coaching Policy.
9.2 A Coaching Session forfeited under that Policy is not refundable or replaceable, except as expressly provided in that Policy.
